Article 1 - Subject matter
The following General Sales Conditions govern the offer and sale of products that appear on the website www.sigmagi.com (hereafter: website) owned by Sigma Gi Srl with registered office in VIA MICHELASSI 4/6, REA business registry number 240383, VAT no. IT00588190488.
The products purchased on the WEBSITE are sold directly by Sigma Gi.
For purchases by customers who are merchants, wholesalers, retailers, professionals and who are not purchasing for personal use, the purchase operations shall be governed by the Italian Civil Code.
Article 2 - Acceptance of the General Sales Conditions
Once the purchase procedure has been completed, the Customer agrees to print and save these General Sales Conditions as set forth in Articles 52 and 53 of Legislative Decree no. 206/2005.
Sigma Gi offers products for sale on its website and carries out e-commerce activities only to individuals who are 18 years or older (or who are legally adults), who have the capacity to consent to and sign binding contracts and who have a valid email address.
Sigma Gi reserves the right to not process orders from individuals who do not fulfil these requirements.
Article 3 - Purchase methods
Purchases of available products as illustrated and described online in the related pages, are carried out by the Customer at the current price indicated, including taxes that can vary according to the country of destination or legislative changes in progress, to which are added the shipping costs that are shown at the time of purchase.
Discounts can’t be combined with other promotions.
The availability of the product is updated based on the number of products available. Since access and the ability to place orders online alter product availability, Sigma Gi does not guarantee the definite allocation of merchandise ordered. In any case, Sigma Gi also offers the Customer the ability to pre-order certain products for which Sigma Gi will notify the Customer of delivery times (which could be longer than ordinary delivery times) and availability by sending an email or contacting the customer by telephone.
Before confirming the purchase, the Customer shall be informed of the unit cost of each product chosen, the total order line, the total cost of the order when more than one product is purchased and any transport costs.
After having completed the purchase order, the Customer will receive a first email message in which Sigma Gi sends notification of having received the order and indicating the order number. In the days that follow, and approximately two business days although this is not a definite and binding time frame, Sigma Gi will send another email to the Customer to communicate that the order was accepted, confirming that the product(s) will be sent to the address indicated and providing the user with an estimated delivery date. Upon receipt of the email, the Customer can verify that the data and products purchased are correct and, if necessary, notify and/or request information from email@example.com or via fax at: +39 05572231250.
Article 4 - Payment methods
Instalment payments are not permitted.
If the Customer has chosen to pay with the credit cards available and indicated online, payment must be made at the time of order. The provider will automatically verify the card at the time of order, sending an email indicating the result of the transaction. Sigma Gi will collect the credit when the goods are dispatched.
If the Customer has chosen to pay a partial payment with a credit card and the balance with a bank transfer, Sigma Gi will quickly communicate the bank coordinates where the transfer must be sent within 5 business days. After 5 business days, the order will be cancelled and the partial credit card payment will be retained.
Prices are subject to change at any time but these changes do not affect orders that have already been confirmed with the methods described above.
If the credit card institution or our service provider refuses or does not authorise or validate the payment for any reason, Sigma Gi is not responsible for delays or failure to deliver the original products.
When the information needed to complete the payment is missing, Sigma Gi reserves the right to automatically cancel the order.
At no time during the order is Sigma Gi able to gain knowledge of the information regarding the credit card and credit card number of the purchaser or the Customer's financial, property and personal data. In fact, this is sent through a protected connection directly to the bank or finance company portal at the time of Customer confirmation. Therefore, Sigma Gi is in no way responsible and cannot be held responsible for any fraudulent and unlawful use of the credit card by third parties during the product purchase and payment procedure.
Article 5 - Delivery
Sigma Gi accepts orders for delivery in Italy, the European Community and extra European countries (not the USA).
Customers may choose to send the goods through our partner courier or indicate their shipping choice (name of the Italian correspondent when shipping outside the country). Upon receipt, the Customer must verify if the number of packages corresponds to what was indicated on the transport document, if the packaging is intact and if the product delivered corresponds to the order. The Customer must sign the delivery note indicating "subject to inspection of product integrity". If this is not done the Customer may not then contest the external non-conformity of the product and quantity ordered after delivery.
Without being binding for Sigma Gi, the goods will be shipped within approximately 7 business days from order confirmation, as always upon prior verification of payment. For orders where Sigma Gi has received notification of payment errors such as, for example, a difference between the name of the individual registered and the owner of the credit card, the customer must make a written declaration stating that payment is being made by a company other than the owner of the credit card. In this case, shipping may be delayed while waiting for the required declaration from the customer.
Article 6 - Merchandise returns and reimbursements
Sigma Gi allows goods to be returned within and no more than 10 business days from delivery for product defects.
The message must specify which products will be returned, the date of purchase and the chosen credit method.
Shipping and reimportation costs will be the customer's responsibility and will be managed by a special carrier assigned by Sigma Gi. The return shipping costs will be deducted from the payment or credit for the merchandise returned.
The product, with everything that was originally included, must be returned in the original packaging (plastic covering, tags, etc.) in order to protect it from damage and sent to Sigma Gi.
Reimbursement will be through bank transfer or a credit on the credit card within 10 business days from the receipt of the goods.
Purpose of the processing of data
Commercial, promotional and/or sales purposes to identify potential customers for each product and service (e.g., internal statistics, feedback, preliminary acquisition of information for concluding a contract or provide a service, etc.);
Research for assessing Customer satisfaction (e.g., research on the quality of the services);
Fulfilment of obligations under the law, regulations or EU standards.
Processing location and method
Processing is performed by specifically assigned personnel via letter, phone and fax as well as automated computer systems. This is performed at the office of the Data Controller and is assigned only to personnel as strictly related to the purposes mentioned above and in such a way as to ensure the security and confidentiality of the data (with particular regard to use of remote communication techniques).
Communication of the data
The personal data collected by Sigma Gi will be communicated and/or processed by subjects entrusted by us who, in order to perform the purposes indicated above, will carry out operational, technical and organisational tasks. The personal data provided by the Customer are used only to perform the service indicated by said customer. The data are not communicated to third parties unless communication is required by law or directly necessary for the requested services.
Rights of the interested parties
The customer is entitled to exercise specific rights. The customer may obtain:
- confirmation of the existence of his/her data even if not yet registered;
- information regarding the origin of the personal data, the processing methods and purposes along with the logic applied in the case of processing performed using electronic tools;
- identification of the Controller and Responsible Party as well as the subjects or categories of subjects to whom the personal data may be communicated or who could become knowledgeable of it;
- the deletion, transformation into anonymous form or blocking of illegally processed personal data, including updating correction and integration of the data as long as it is not impossible or does not involve the use of disproportionate methods. The Customer may also, for legitimate motives, oppose the processing of his/her personal data, as well as the purposes of the collection. The Customer may also oppose the processing of personal data related to advertising material or aimed at performing market research and sales communications.
Article 8 - Legal Jurisdiction
The sales contract is governed by Italian Law.
The Florence court shall have jurisdiction over any dispute regarding the interpretation or execution of this contract.
Article 9 - Changes
The conditions contained in this document may be modified by Sigma Gi without any prior notification and will be valid from the date of publication on the website www.sigmagi.com.
Article 10 - Complaints
Complaints should be sent to the Sigma Gi spa registered office in Via Michelassi 4/6, 50018 Scandicci (FI), Italy.
Article 11 - Additional information
The contract and all communications will be in Italian or English.
